Welcome to NÜDE Nail Spa (“NÜDE,” “we,” “our,” or “us”).

By booking an appointment, purchasing products, or using our website, you agree to these Terms & Conditions, which outline the rights and responsibilities between you (the “Client”) and NÜDE Nail Spa.

We encourage all clients to read this page carefully before booking or purchasing.

1. Business Information

NÜDE Nail Spa operates in North York, Ontario, offering nail, waxing, lash, facial, and massage services.

Our establishment follows the Ontario Ministry of Health Personal Service Settings Guidelines, the Health Protection and Promotion Act, and local Toronto Public Health standards for safety and hygiene.

2. Appointments & Bookings

  • Booking: Appointments can be made online, by phone, or in person.

  • Deposit Policy: A non-refundable deposit (typically 25–50%) may be required for selected services or large group bookings.

    • Deposits are applied toward your total service cost.

    • If you cancel or reschedule with less than 24 hours’ notice, the deposit is forfeited.

  • Cancellations:

    • 24-hour notice is required to cancel or reschedule without penalty.

    • Cancellations made with less than 24 hours’ notice or missed appointments will incur a late cancellation/no-show fee equivalent to 50% of the service cost.

  • Late Arrivals:

    • Please arrive at least 10 minutes early.

    • Arrivals later than 10 minutes may result in reduced service time or rescheduling at the spa’s discretion.

  • Group Bookings:

    • Groups of 3 or more require a 50% deposit and 48 hours’ notice for cancellations.

3. Payments & Pricing

  • All prices are in Canadian Dollars (CAD) and subject to HST (13%).

  • We accept Visa, Mastercard, Interac, and cash.

  • Prices, packages, and promotions are subject to change without notice.

  • Discounts, vouchers, and gift cards cannot be combined unless explicitly stated.

  • Promotional pricing is valid only during the advertised period.

4. Refunds, Redos & Adjustments

  • Service fees are non-refundable once a service has been performed.

  • If you are unsatisfied, please notify us within 24 hours of your appointment. We may offer:

    • A complimentary fix, adjustment, or partial credit (at our discretion).

    • Refunds are not available for completed services, gift cards, or deposits.

  • Retail items may be returned within 7 days if unused, unopened, and in original condition with proof of purchase.

5. Health, Safety & Consent

  • All tools and equipment are disinfected and sterilized per Toronto Public Health regulations after each client.

  • Please inform us of allergies, medical conditions, infections, or sensitivities before your service.

  • We reserve the right to refuse service if a condition presents a risk to you or others (e.g., fungal infection, open wounds).

  • By accepting services, you consent to:

    • The reasonable physical contact required to perform treatments.

    • The use of professional products deemed necessary by your technician.

  • Client information is collected and protected under Ontario’s Personal Health Information Protection Act (PHIPA).

6. COVID-19 & Health Screening

  • Clients showing symptoms of illness (e.g., fever, cough, flu-like symptoms) may be asked to reschedule.

  • We maintain enhanced sanitation and ventilation in compliance with Toronto Public Health COVID-19 protocols.

  • Face masks may be required during high-risk periods based on local regulations.

7. Minors & Parental Consent

  • Clients under 16 years old must be accompanied by a parent or legal guardian.

  • Certain services (such as waxing or lash extensions) may be restricted to clients aged 16+.

  • Parental consent is required for any treatment involving skin exposure.

8. Personal Belongings

Please secure your personal items during your visit.

NÜDE Nail Spa is not responsible for lost, stolen, or damaged belongings.

9. Gift Cards & Prepaid Packages

  • Gift cards are final sale, non-refundable, and not redeemable for cash.

  • Gift cards do not expire under Ontario’s Consumer Protection Act, unless linked to a promotional offer with a defined end date.

  • Prepaid service packages must be used within the timeframe stated at purchase.

  • Lost or stolen cards will not be replaced.

10. Conduct & Right to Refuse Service

We strive to maintain a calm, respectful, and inclusive atmosphere.

NÜDE Nail Spa reserves the right to refuse or terminate service to any client who:

  • Displays inappropriate, aggressive, or disrespectful behavior.

  • Appears under the influence of drugs or alcohol.

  • Refuses to comply with hygiene, health, or safety standards.

11. Accessibility (AODA Compliance)

We are committed to providing services in accordance with the Accessibility for Ontarians with Disabilities Act (AODA).

Clients with accessibility needs are encouraged to inform us in advance so accommodations can be made.

12. Website Use & Intellectual Property

  • All website content (including text, logos, and imagery) is owned by NÜDE Nail Spa.

  • Unauthorized copying, redistribution, or commercial use of any content is prohibited.

  • Our website may include third-party links for your convenience; we are not responsible for external site content.

13. Privacy & Data Collection

  • We collect personal information (name, phone, email) only to manage appointments, send reminders, and improve services.

  • Health information shared for service purposes is stored securely and not shared with third parties without consent.

  • Data handling complies with PHIPA (S.O. 2004, c. 3) and PIPEDA (federal) standards.

14. Liability Waiver

By receiving services, you acknowledge and agree that:

  • All treatments carry inherent risks, including potential allergic reactions or irritation.

  • NÜDE Nail Spa, its employees, and contractors are not liable for injury, loss, or damage arising from services performed, except in cases of proven negligence.

  • You assume full responsibility for your own health and any adverse outcomes that may result from your failure to disclose relevant health information.

15. Promotions & Social Media

  • Promotions and discounts are valid only within the stated time frame and cannot be applied retroactively.

  • By tagging or sharing photos with our spa on social media, you grant us permission to repost or feature such content, unless you request otherwise in writing.

16. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of the Province of Ontario and the applicable laws of Canada.

Any dispute shall be resolved in the courts of Toronto, Ontario.

17. Amendments

We may update or revise these Terms & Conditions at any time.

Changes take effect immediately upon posting on our website.

Your continued use of our services constitutes acceptance of the revised Terms.
